My question involves real estate located in the State of: California, County of LA
My neighbor informed me that the will be building a block wall fence. They had the property surveyed and it turns out their property corner is about two feet in my driveway. Their proposed fence (waiting to see drawings) will extend into the driveway, causing me to lose use of part of the driveway and making it difficult to drive up and back up our driveway since the wall will be in the way.
I spoke with the neighbor about my concerns for a corner of the wall becoming my front-door view, losing the use of the driveway as it currently stands and the loss of curve appeal. They simply said that they don't want to lose any bit of their property.
Here's what I'd like to accomplish:
1) Have the neighbor build their wall, but curve the wall at the property corner in question so that I don't lose use of my driveway, etc. The paved driveway has been in use as is for over 50 years.
2) There's a tree planted on the property line which would make it impossible for them to build a straight wall to the corner unless the tree is removed. I don't want the tree removed. I maintain the tree.
3) I will be willing to buy the few feet I need to keep my driveway as is and compensate for additional costs to the owner to curve the wall.
4) If they are unwilling to play nice, what legal options do I have?
