My question involves independent contractors in the state of: New York
Can an independent contractor who interacted with a customer be liable for a fraud committed by the company the independent contractor worked for? Here, the independent contractor worked as a sales representative for the business (for commission, no salary or benefits; he filed self-employment taxes), and made representations to the customer that he thought were true, but were not. Mainly that the customer's deposit would be deposited in escow. It was not so deposited. The business is now bankrupt.
