So here's an odd scenario about a rental car accident in Florida. It doesn't involve injuries but I didn't really see a better place to post this...
My brother rented a vehicle in Florida and was in an accident that totaled the car (as far as he can tell it looked like a total loss). His insurance covers rental car accidents but today he noticed that the rental agreement is actually in my father's name. The attendant that checks the rental agreement before letting the car leave the lot didn't mention that the agreement didn't match his license and my brother didn't notice until he called his insurance. My father passed 3 years ago and his estate is closed and my brother was neither his POA or executor. My father used this rental company for rentals when our cars were out of commission due to accidents and I guess the last name just pulled up his info rather than adding my brother's name to agreement (my brother still lives in the same house as my father's old address). So I'm not entirely sure what this means.
I'm guessing that my brother could not enter into a contract with the rental company under my father's name as he wasn't the POA or executor and his estate is closed. Correct?
The insurance company is balking at paying due to the rental being under my father's name and not my brother's. My father was the original policy holder for my brother's car insurance (my mother is now the policy holder) but as he his deceased he was removed from the policy. Does my brother have any recourse regarding the insurance if they refuse to pay? He also needs to check with his credit card company as to whether they cover rental cars in any way.
Lastly, I have the same name as my father (my name is the exact same except the II at the end). Is there any way they could come after me? I haven't lived in my parents home in over a decade and I wouldn't think that my brother could enter into a contract for me but I'm still a bit worried. Any thoughts on this? Thankfully, I have rented a car through that company through work in a different state (a state that I lived in) than where my parents lived in the past few years. So I feel that I could prove that the name/address on my brother's agreement was my father and not me but I'd really like to avoid having to pay attorney's fees and whatnot.
