My question involves a child custody case from the State of: Florida.
My Fiancée just moved out of state with her kids a few months back. I knew there was a possibility for a few issues when I met her but nothing like this. Her and her ex were never married just engaged to be married so according to what I have read is that until a court order has been placed there is nothing illegal about what she did because there was no parenting plan or court order against her. A few days after she left he filled for a custody case. He served her an "unofficial parenting plan" to her parents house where she was staying at the time. She received them about 5 days after she arrived. The next thing she received was a parenting plan and a default about 2 months after she moved. It pretty much says she got a summons and didn't respond to it which I know she never received a summons because I spent pretty much every free moment we have had since right before the date it said she received it. Everything she was sent had the wrong case number on it. She replied with a cover letter and a copy of a parenting plan with the wrong case number . A few weeks ago we got a call from a sheriff saying if we didn't meet them in 15 minutes she would go to jail until the hearing on the paperwork. We called the court house and they informed us that there is no hearing scheduled for that date. Right now the last thing we can see on the court records states that there is a final judgment of paternity. All of his paperwork seems to me like there is false information. Is it to late or is there anything we can do to stop or basically go back to the start because right now it looks like she hasn't been doing anything even though I personally know she wouldn't just give up on this. Also is there anything we can say about the separation of siblings. Is there anything we can do to start our own case or would it just be thrown out because of the ongoing case
