Home Insurance: Insurance Check for House Owned by Two People Cashed by Only One. Forgery

My question involves insurance law for the state of: Texas

This occurred in 2008
My mother owns half of a house (now just land) and my brother in law and sister own the other half. The house was left vacant and a few months later caught fire. We (me and my mom) found out that my brother in law had taken out an insurance policy a couple of months prior. Long story short, he received a check from the insurance company and spent the money. He did not rebuild the house. He did not give my mother any of the money either. He stated he used the money to pay a lawyer to fight the insurance company and to clean up the property.

My mom never signed anything, she didnt sign up for the insurance, and she never signed the check. I though when a property is owned by several individuals the check is made out to those involved and signatures are required. We are wondering if he committed forgery and if we should take him to court for that.

There are many more details to this but I have summed up what I see important. I am not sure how to proceed now or if I should get a lawyer considering it was so long ago.

Needless to say, the relationship between me, my mother, and my sister and her husband has been greatly strained due to his (what we feel) conniving ways. He wants to subdivide the land now since my mother refuses to accept his buyout. I feel like he is getting away with something that he shouldn't and I want to know if I would have teh law behind my efforts to move forward and help my mother.
