My question involves real estate located in the State of: New Jersey
I put in a contract on a house in 2009. After the inspection a number of issues concerned me (radon, mold, asbestos, water damage, etc.) The seller was very uncooperative. I tried to get them to cooperate in the sale but they made it very difficult which added to my concern (this was not an "as is" sale). I ended up cancelling the contract. They sold the house 6 months later for $50,000 less than what I offered. They sued me in 2010 for the $50,000 difference and legal fees, about $60K and they held back my down payment of $10K.
After going back and forth for a few years in 2012 the case was closed. I verified with the courts that it was in fact closed. The $10K down payment was returned by their law firm. I considered this done.
I just started getting marketing mailings from firms to help pay off a lien. I checked my credit report and saw a $60K lien from the court. I didn't connect these two issues as it was so long ago and ended up contacting the court and found that this was from this same case, same docket that was listed as "closed" in 2012. I never received any notifications that this case was re-opened and that there were many settlement conferences and arbitration hearings. I have the list of notifications from the court and they state that I was notified many times, this is not the case. They have my correct address and I have not moved.
Questions:
1. How can they open this case without notifying me? If they did, which they claim, how can I get these records? Is it my word against theirs?
2. This lien is on my credit report and tanked my credit score, will this remain for 7 years? How do I get this off?
3. What should I do next? I am engaged with my attorney who worked with me on this situation.
