My question involves traffic court in the State of: California.
Today I was driving from Nor Cal to So Cal. About half way on the highway and I was doing about 90mph. I saw well in advance that a marked patrol car was getting on the freeway in front and in slowed to the appropriate speed. 70mph. The officer got on the freeway and pretty quickly was doing about 85. I was pacing him because I'm an idiot. Pretty quickly he began to slow so I did as well. He sped up again and I let him get a little further out and then I began pacing him. Again because I'm an idiot. I should be a little more clear, there were two main accelerations but I was alternating braking and acceleration because be wasn't keeping a consistent speed. In retrospect I guess he was trying to pace me. Nevertheless, he slowed way down and merged over waiving his hands and pointed for me to pull over. So I did. He said to me you were pacing me at 80" and then gave me a ticket for 81.
Now, I've been doing some research and it's hard to find much on pacing from the front. I guess I have a couple questions.
1. Can he pace me from the front? Seems like I'm pacing him in that case. Is there a legal distinction?
2. What I've read says to pace me he has to match my speed for a reasonable amount of time. That's very difficult to do from a rear view mirror and how can he match me speed if I was accelerating and decelerating the entire time?
3. I'm guessing it means nothing but does it matter that he said 80 and wrote 81?
4. Perhaps he was on a call that got cancelled but if he wasn't, my understanding is that he shouldn't have been speeding. I can't seem to find a clear answer so I'll ask it here, Do I have any grounds if I was matching his speeds and he wasn't on a call?
I get that I'm an idiot and fully deserve the ticket but my job is really not going to like me getting a ticket. And It feels like he just threw out an educated guess just to be a dick. And he was definitely a dick while I was super nice. I don't particularly like that either.
The courthouse is 5 hours away. If I'm going to try and fight it I'd really like to know that I have at least a reasonable chance of winning, if he even shows.
I'm pretty savvy and I could do the research to make a case. I'd just like to know if I have any grounds on making a case before I commit the time.
