My question involves court procedures for the state of: CA
to make a long story short. A business owes me money for the work I done. They won't paid me. So I took them to small claim court. At small claim court we went to mediation and had a mediation agreement for the defendant to pay me a lessor amount by a certain date. The judge review and signed and set a compliance date which is next Wednesday where both of us are to appear if any of us break the mediation agreement.
I have been calling the other party and they are not answering the phone and they have not paid me by the agree upon date, they have not paid me at all. So what if he does not pay me, I go to court, right on compliance date.
And if I go to court will the Judge order (or enter judgement) the other party to pay the agreed upon settlement essentially enforcing the settlement agreement??? What will the judge usually do?? Can I ask the court to fine the other party???
