My question involves labor and employment law for the state of: California. Hello a friend of mine had been dating a man who is the ceo of his company who she was also employed by. Well they were together long enough to have a daughter before things went bad enough for her to get a temporary restraining order against him. Which was not really a problem considering his company has a few different offices in different towns in california, so she worked at a different location than he did and he didnt have a problem obeying the rules of the temp restraining order. Later when they went to court she was granted the "official" restraining order or whatever its called, she decided not to show up to work the very next day she was scheduled and had another co-worker fill in for her the next day after that. So the ceo's brother which is her manager was concerned about her well-being because she was his employee but was also sort of family right before all of this happened, so he called her to see what was going on and ask if everything was alright and to ask why she wasnt at work the previous 2 days. She told him she wasnt there because she didnt feel like being there very rudely and hung up on him. So she did show up to work a little late the next day, but everything that the manager said or asked her to do was met with an attitude or very rude comment that went on for the next 2 days. So just like with any employee who no-call/no-showed and came in late and was very rude to their manager he met her on her next scheduled day with her final paycheck. Well she turned around and is sueing the company for firing her only because she got a restraining order against the ceo. How does the courts in california deal with this kind of case.
