My question involves criminal law for the state of: Connecticut
I was at a concert tailgate and I was standing in a large group of people and they were drunk. They were throwing their alcohol cans around and placing them places and I went and picked one up and as soon as I did a cop is right there and asks me for my ID. I am 20 years old so i am clearly underage, however, i was not drunk, nor do i ever drink alcohol due to medication that is necessary for me to take that i refuse to not take just for the purposes of getting drunk. i requested a breathalyzer, but he refused to give me one. He also called my parents and they also said i do not drink either and requested a breathalyzer, he still would not give me one. My friend who was also caught told him that he could send her to court but not so send me because i have never had a sip of alcohol this entire day. the officer kept saying to me well you are clearly not drunk, but you had this in your hand. the officer was also extremely disrespectful to us and was borderline harassing my friend. he wrote both of us a summons to court. do you think that there is a possibility of me getting this dismissed? i understand that it is highly unbelievable that a 20 year is not drinking at a concert filled with drunk people, but it was very obvious that i was completely sober so I'm wondering if i would still have to pay the fine. also if i should call a lawyer to ask their opinion.
