My question involves landlord-tenant law in the State of: Florida
Hello! I made an account for this so please tell me if i do something wrong. To get to the problem, I am a lease holder for a house and have brought in a roommate under a vocal agreement. I understand this was my mistake not getting a written contract but I guess this is how I learn. Well, when my roommate moved in I asked for a first month and a last month rent and that was back in September. Fast forward to about a month ago in the last week of February. I had voiced some concerns about him living there and said that it might be for the best to save the friendship if he were to move out. He responded by showing up several days later and moved out completely with no notice whatsoever. I was annoyed but i can still pay rent so I wasn't too bothered, especially since he seemed to purposefully be trying to leave before the 1st and dodging a rent payment.
This is were the problems really start, I was fine with this. I had the last month rent that he paid when moving in and wasn't too upset. However, he harassed me for several days afterwards saying that the last month rent should retroactively apply to the February 1st payment and that he should be given a refund for what he payed. Now it is my understanding that a last month rent is meant to act as a safety net for situations just like this when someone tries to skip out on a rent payment. This all happened a month ago and i was okay with letting it die but now my parents have been contacted by someone who I can only assume is a lawyer in regards to a problem with the ex roommate.
Could he have any legal standing here? I imagine the lack of a written contract makes things more difficult but everything i read tells me that last month rent requires a prior notice for when you want it to be applied, not leaving and then saying you want it to work now.
