My question involves a traffic ticket from the state of: Pennsylvania
I was just heading over to visit a relative when I made two stops on a one way street.
Keep in mind, BOTH streets that intersect with the one way road I was on did NOT have a line painted on the road, but the stop signs were visible.
First stop, there was hardly any visibility from the south end of a two way street(house on the corner, cars, trees/bushes) and barely much visibility on the north end. So having to inch my way passed the stop sign slowly to see if I could go was what I did in order to tell if anyone was coming my way on both side. Luckily, there was no one around(neither driver nor pedestrian).
By the second stop, it was a one way street heading north, and there was an abandoned Jr. High blocking my view(metal fence surround a generator and the foundation), obstructing any possibility of seeing coming vehicles towards me while the south end was barely visible as well. Again, no vehicles nor pedestrians, and having to inch my way passed the stop sign to see.
In other words, two rolling stops, and all because I can't make heads or tails of one side being obstructed by whatever was in my way from one side, and the other was hard to tell who was bound to come my way.
Just to give you an idea, My car is a sedan, and seeing from a height of 4'11" versus an obstruction full of trees/bushes and other parked vehicles that stood beyond 5' tall(if I were standing, I'd be 6'1" tall) while being expected to make a complete stop in front of a stop sign is darn near impossible.
Anyway, upon the second stop, I noticed lights flashing behind me. So I pulled over with my four ways on. The cop got out of his cruiser and told me that I "blew through two stop signs", meaning "I drove passed both with stopping once" when I had, but only to inch myself a bit to see if anyone was heading my way.
I didn't want to argue with him and get into any deeper trouble. Then questions why I was shaking. I told him "because I am autistic, and havent had anything to eat at all", which are both true.
Just so we are 100% clear, I have high-functioning autism. And I can drive like anyone else, but that doesn't mean I am fully incapable of operation a vehicle. I've been driving for 10 YEARS, I've got a job as a part-time cashier, and I am independent. Therefore, destigmatizing the stereotype. Yet, that shouldn't mean I am to be denied of having the priviledge of traveling on the road when I am a safe driver regardless despite my personal quirks. I've overcame a lot in life. And driving is more important to me than not. As for the hunger part, I am diabetic. Low blood sugar, high blood pressure, & a former anorexic(age 27)/childhood obesity victim(age 10-18). Whether or not thats important, I had to say it. And my age is currently 30(31 on April 11).
The cop asked me if what I did was "common practice". I told him "no, officer". He gave me a fine of $129, and I know I made both stops. Yet, it wasn't my fault people parked their cars and had homes, trees, or buildings obstructing my view.
I know of the three second rule. I know what I did, and I had made those stops. But how could I see in front when the streets were more visible from behind the stop signs? And I don't mean they were stops that blocked oncoming traffic. I mean, stops to where you had to SEE anyone coming or going without being in the way of an oncoming vehicle. And again, NOBODY was on the road nor the sidewalk.
4 days after the incident, I took pictures of the locations where I was the day I got pulled over, and got both sides and the front view of where I'd stop. Not only on the first stop, but also the second stop. And since there was no line painted to indicate where the limit was between the stop sign and the veichle, it proves how impossible it was to tell when traffic is coming or going.
Sorry for the rant(part of my quirk), but I plead not guilty just to get my 3 points taken off, and my insurance to not go up. And since I have pics proving that my charge is bunk due to obstruction from the front of both stops, would I have a good chance of winning my case? And if so, what's the minimal charge I'm to get from all this?
I got a hearing with the magistrate on May 2nd. I hope that my charges drop or the very least pay a misdemeaner with no points on my license. Whichever or whatever the result is, I'll do it.
If there is ANY advice on having to fight this, let me know.
