My question involves a child custody case from the State of: Pennsylvania
Good morning, this is a long complicated story but I am going to try and be short and to the point... My (soon to be) ex husband has been in prison for 3+ years and was charged with corruption of a minor and sexual assault of a minor. At the time of the crime we were separated and I had NO idea what was happening until he tried to take his own life when he was caught. Before any of this happened he was a good father to my son , but I am very torn on what to do when he gets out in 6 months. I do not trust him, he started drinking heavily right before and during our separation and clearly expressed his anger toward me for leaving him. I think it is important to note that the victim of his crime was not my child , she was 13 and he was 30. Because I have finally started the process of an official divorce (although we are already legally separated) I do not know how to go about custody issues. My son was only 6 when he was sent to jail , but now that he is approaching 10 he understands the situation a little better, he shows that he is angry with his father and cares less and less everyday about what happens to him. Because my son was so young I never allowed him to write or visit his father and its enforced " out of sight out of mind". I am not even sure if he is able to be granted any kind of custody because he will be a registered offender for life and on Megans list. Are the rules not "any contact with a minor" ? Honestly I do not want to deal with any of this, the past 3+ years have been great for us and I do not want to re-open any wounds my child may have because of his idiot father. I know he is going to be so angry when I try and explain why I think it is in the best interest of my son that he just stays away. From some research I have done I know it may be possible to have his rights terminated under the circumstances but while doing that I would need a PFA as well. I know he wants to be in his sons life but he has abandoned him for such important years of his life. Does anyone know what restrictions a sex offender has when it comes to his own childs custody? I believe he is being forced into a half-way sort of situation when he goes on parole but from then on I would be very interested in hearing what rights I have and how I can minimize the drama and contact with my ex. Any help is greatly appreciated.
