My question involves real estate located in the State of: Michigan.
Facts of the situation:
1. long time condo owner
2. no restrictions on number of cars allowed per condo
3. for over five years have parked two cars in driveway in front of unit.
4. Assn has recently created rule limiting cars in the driveway to ONE.
5. Some phases/areas of the development have 'extra' off-street parking for multiple vehicles.
6. The section where we are located does not.
7. Assn Board provided notice of the new rule in a recent monthly newsletter, but no other notification.
8. They have now been sent a post-dated notice that we are in violation of the rule and the Assn intends to fine and tow.
Can the assn do this after such a long period of practice in which we have had two cars in the driveway?
Both cars in good repair, registered, etc. etc.
