Consumer Law Issues: Can You Choose to Have Refund Instead of Replacing for a Defective Item

My question involves a consumer law issue in the State of: Texas

I recently picked up a pair of prescription lenses. The lenses are defective and not useable. I returned to the shop trying to explain to the merchant what was wrong, the merchant was very rude and refused to admit it's defective, but was willing to "go out of his way" to replace it. The merchant texted me late at night after he found out of my review posted online (I only gave my phone number for service purpose when placed my order) saying he won't do anything if I don't take off the poor review. I picked the lenses back, and double checked with an experienced optician. The lenses are confirmed to be defective, and are made inconsistent of my prescription power!

I plan to go back to the merchant one last time and inform him that the lenses are confirmed to be defective. Can I request to have full refund, even when the merchant offers to replace? The receipt says no return.

Thanks for all the help.
