My question involves a consumer law issue in the State of: Missouri
We have been in a new subdivision for two years. New neighbors moved in two months ago and immediately putting up a fence. They hired a contractor to do so. Today they placed and poured their fence between our property lines. They have placed their fence on the very line of the center of the easement between the properties. However, the contractor dug the holes and concreted so large, they have dug up the sod on our side and even dug up our sprinkler system. We are not even sure if its legal to build a fence within the easement. But now we are certainly not happy about our expensive professionally installed sprinkler system being dug up for the placement of their fence. Who is responsible? The homeowner or the contractor and what recourse do we have?
