My question involves a child custody case from the State of: Virginia
My fiance is going through a custody battle with his daughter's mother. The last court case the mother received temporary custody till the next court date which is very soon.
Even though my fiance has a ton of evidence that she is an alcohol and drug abuser, working in a illegal establishment, suicidal, and does not live in a stable home. Also evidence of her stating she cannot take care of their child ( couldn't even enroll her into school) and practically gave their child to live with my fiance and I. His daughter lived with us for 4 months. The court still believed their child had to live with the mother. Mostly because she has a letter stating the child will return to her after the holidays. The court date was 2 months ago.
The court order stated that both parents must take a hair follicle drug test, go to a parenting class, and give each other and the court any addresses if either one moves. Her drug test came out positive for multiple substances. My fiance was/is clean.
Recently he received a phone call stating that ACS was knocking on the mother's door. They made her take a urine drug test ( which she also failed ), took pictures of the living area ( which is filthy, the child sleeps on the floor), visited her work establishment and found out she works illegally, and that their daughter does not have medical insurance. The social worker told her that they will be back for a second visit this week or the next, because the mother told them they are moving. Two days after, her and their daughter was kicked out of the home they lived. Apparently the mother has not been paying rent and has been stealing from the head of the house. The mother wrote on social media that she is homeless.
Here is some reasons and evidence we have.
-The mother, daughter (5 years old), and mother's husband lived in a house with her brother, his fiancee and their daughter (1 year old). The brother told my fiance that the mother was stealing her brother's baby's milk to give to make her daughter cereal. The daughter told her mom that she didn't want cereal and the mother told her, " You are going to eat what I give you. You ungrateful little bitch".
-When she was living with my fiance and I .. she told is that she knew what sex sounds like. She was playing with a squishy spider she got on Halloween and said it felt like a penis.
-She pointed out when we was watching a movie that her mom smokes a bong.
-When her mother sent her to live with us. She was very thin. When she ate it was as if she never ate in her life. Her teeth is dissolving because every single tooth has a cavity. All of her clothes and shoes she came with was worn out, bleached and too small.Even her underwear had holes in them.
My fiance and I are worried for his daughter's health and safety.
The fact Acs went to her home, does that help his case? Is the fact that there is so much wrong from what I described, will their daughter be taken away from the mother by ACS? What can he do to make a stronger case?
