Adoption of Children: Stepparent Adoption with No Acknowledgement of Paternity

My question involves adoption law for the State of: Texas

I'm curious to know how difficult it would be to file for a stepparent adoption if the biological father never acknowledged his paternity. He's not on my son's birth certificate and he never tried to have a relationship with him until I got married. He never paid child support until the end of 2014 and then stopped paying again in 2015. So, he has never really tried supporting him either. My husband has been in my son's life since he was a year and a half and he is now 6 years old. So even though the biological father isn't technically his "legal father" I know he would still try to fight the stepparent adoption and wouldn't willingly sign over his "rights" (if he even has any). Any advice is greatly appreciated. I just want to know if I even have a case here. To me, it's worth fighting for.
