So my grandpa passed away in may and he took care of my cousin who has a mental disability and has benefits provided by the state to her. She is still living at the property that my grandpa owned and has her own lease for her section. My family wanted to rent out the other room so I have a separate lease and agreement through the home owners (my family.) The state wants to take away some of her benefits because I am family and living at the same residence as her. Mainly they want to take away her home health care hours. My defense has been we are tenants of two separate areas, alot like an apartment building that has 2 apartments. I have my own area that I lease out and she has her own area that she leases out. Yes I am related but i work full time and go to school so it cannot be expected that I be there every night nor should it be expected that I would provide "natural care" as they call it. I am not her guardian and I am nothing more as a tenant in the same building that she also is a tenant in. Anything I could reference to help my case? I don't want to see he lose her quality care that she has been receiving because I moved it.
