Boundary Agreements: Driveway Easment

My question involves real estate located in the State of: my family has used our lane, the only access to Port Clinton,
Road, for over forty years. Now the adjoins land has new owners. We are having a dispute on the property which is a mess. But one matter is the drive way. We have used for over forty years and we have maintained it even though it belongs to the neighbors. The previous owner lived in California and rented the house out to terrible tenants to say the least so we have maintained the lane for over forty years as well. Are we not protected thru a prescriptive Easment? Do we need to file a lawsuit to obtain this or is this a right that comes with time? Any thoughts on the matter are greatly appreciated.
