My question involves real estate located in the State of: Texas
My survey shows the existing fence line a few feet away from the property boundary (on my land). We want to build a new fence along the boundary by moving it by the few feet that our survey indicates. My neighbor showed me her survey and her survey put the old fence along the property line, so if we now shift our fence she thinks it is on her land. I spoke to my surveyor; he thinks our survey is correct since he found all the property corners that our deed calls for while my neighbors surveyor set new iron rods/corners. Our common corners (from the deed) do not align and my surveyor thinks that my neighbors surveyors starting point (since he set new rods) was wrong and the survey shifted. How do we figure out where the actual boundary is, which survey is correct, to get this settled? My neighbor does not want to talk to her surveyor since she believes that her survey is correct. It is not really about the fence for me (just a few feet), I would be OK to put it where the old fence was, but I would prefer to get this settled so there is a common understanding of the boundary. What would be a good next step, who to contact?
Another question, if I now move the fence where the old one was (to keep a good relationship), can that be interpreted as I am agreeing that is the actual boundary and her survey is right? Could I lose my land in that case? Could there be problems down the road when we sell our land or she sells hers?
