My question involves a child custody case from the State of: New Jersey
My ex's attorney sent me an order to show cause motion. On there it had the dates where she emailed me the packet, overnighted it and hand delivered it to the judge.
On the first page it starts by saying " please take notice: that on an emergent basis, on September 14, 2015 at 9 am or as soon as soon as council may be heard, the attorney for the defendant shall go before judge xx for an order as follows
1.. Blah
2. Blah
3. Blah
4. Defendants attorney fees."
There are no other dates on the order, affidavit, or certification. The judge didn't sign anything....
In there it says you to respond to the motion/submit a cross motion by a certain date (but there's no date). All motions must be filed on the Tuesday, 24 days before the return date (there's no date)
It says I should respond to the motion by sending it to his attorney.
Well the ex basically lied about 90% of the statements he made in this document. I was preparing my response and all the exhibits I have to show that he down right lied and committed perjury. When we met for our visit exchange I showed him all the proof I had of his lies and informed him I would be asking for my attorney fees as well. He told me he was going to withdrawl the motion....
As of today, I haven't received any letters from his attorney or the judge stating it was withdrawn. I haven't spoken to an attorney bc he told me he was withdrawing it...
Would I receive something from the attorney or judge? Do I wait to hire an attorney until I receive a document with court date and its signed by the judge? I don't want to pay an attorney if he did withdrawl it.
I'm very confused because there were no other dates.... The only date is September 14th and that's the day I received it. The attorney didn't even hand deliver it to the judge until 9/15.
How do I know when I need to respond if there's no dates?
Idk if I explained this right or if I just confused everyone lol.
Any advice, suggestions would be appreciated.
