My question involves real estate located in the State of: CA (unincorporated Alameda County)
I am the uphill homeowner, my neighbor is the downhill owner. He asked us to help pay for the leaning retaining wall between our properties. Seemed fair. I told him to get some estimates, and I would get some estimates.
During my process of getting estimates, I found out I needed a land survey before the engineer would draw up the plans for the wall. Everyone agrees the wall cannot be repaired and must be replaced. The wall goes from 2' at the front to 9' in the back, and is approx. 30' long. Told I will need the plans drawn up in order to get the estimates done. A couple of companies gave me very vague (verbal) estimates between $20.000 - $60,000. Have heard nothing from the neighbor regarding any estimates he may have received.
I have the land survey in-hand. (have yet to share with the neighbor, but will) I sent the PDF and CAD survey to the engineer to give me proposal to draw up the plans. When he received the survey, his email comment was: Does your neighbor know the wall is on his property only? Shall we send the proposal to him?
My question here is this: Do I have any legal obligation what-so-ever to help pay for this wall?
