My question involves real estate located in the State of: North Carolina
So my wife and I are buying some farmland in NC. Currently there is a gentleman that is leasing the property for his cattle and to store his hay in the old barn. When we went under contract, we agreed that he would have up to 60 days after closing to remove his cattle and hay and that he would be notified as such. Well, our closing is quickly approaching. We have repeatedly requested proof that she has notified him that his lease will not be renewed at the end of June which is also our closing date and that he will have to sign a new lease with us to span the 60 days or until his cattle has been removed. This would give him the option to go ahead and begin the transition or wait to be sure that we go through with the purchase and just pay us the lease fee.
To date we have received nothing. We have requested that this all be in writing and signed by all 3 parties. We even offered to have it drawn up legally if everyone felt more comfortable. It turns out her lease agreement with the cattle farmer is verbal only. I just don't want to end up with a squatter type situation of someone that says I ain't leaving! Any advice would be greatly appreciated.
