Neck injury, fusion, wage loss, etc. due to an accident in Florida in Nov 2009.
* 1st Auto accident in Nov 2009. Neck paid and left shoulder pain. C4/5 and C6/7 showed disc distortions. Doctor prescribed a surgery of funsion in C4/C5 and C6/C7 respectively. Surgery was scheduled but I did not go. The driver at fault passed away in 2010. Her insurance company paid up to the limit $100,000.
* 2nd Auto accident in Nov 2011. Surgery was done in early 2012 by a New York City doctor.
* The Under-insured Motorist of mine during the 2nd auto accident paid $125,000.
Now I am suing the my Under-insured Motorist policy carrier for damages over the $100,000.
I have two difficulties:
# the NYC surgeon had unfavorable statements in her notes for me such as aggressive physical therapy had resulted in a resolution to left radicular pain after the 1st accident and before the 2nd accident. But the image films showed no much differences in C4/C5/C6/C7 between the 2 accidents.
# I have been self employed and was a start up since 2006 as a Professional Engineer. My personal and business incomes were a little from 2006 to 2009, during the surgery and after the surgery.
How do I overcome the two difficulties?
