My question involves an accident that occurred in the state of New York:
Vehicle 1 was driving eastbound approaching an intersection when Vehicle 2, driving southbound, pulls out in front of Vehicle 1. Vehicle 1 strikes Vehicle 2 in the rear causing Vehicle 2 to hit parked Vehicle 3 in the rear, which hit parked Vehicle 4 in the rear.
The police report indicates contributing factors were "unsafe speed" (Vehicle 1) and "failure to yield right of way" (Vehicle 2). Driver of Vehicle 2 stated he made a complete stop at a stop sign before entering the intersection where the accident occurred. No injuries, no citations, no arrests.
In such an accident, how do adjusters decide to what extent their insured is responsible or their percentage of responsibility? Do points of impact/vehicle damages or traffic tickets influence the decision?
Do certain contributing factors within an accident report outweigh others or are all factors equal in the mind of an adjuster?
If the insurer of Vehicle 1 is only accepting 5% liability and Vehicle 2 is accepting 10%, aside from going through their own insurance company, what can the owners of Vehicle 3 and Vehicle 4 do to receive more from the insurers for damages to their vehicles?
In your opinion, based on the scenario above, which vehicle appears to be more at-fault?
