So I am in a holding pattern to be scheduled in front of a ALJ. I am being told I have to repay $5100 to SS because I was the executor of an estate for my mother, and she got two years of over-payments before she passed away. The overpayments were not her fault, but because I did not officially close out the estate, the SS wants me to pay it back. I did pay all my mother's creditors, and there was $9000 left over. It was split between my two brothers and I. (I got about $3800 adding some costs)
Here is the dilemma. In the informal hearing Nov 2016, they told me I could not include my 58 year old brother's living expenses because he was not officially on SS disability. Last week he was approved for SS, retro active to Dec 2016 when we filed. So, should I ask to speak to someone in SS and give them this update? It seems big to me, but not sure it will be to them, and I do not want to rattle any cages. He has been with us since Aug 2016 and I spent over $1500 on him since then. He has Alzheimer's Disease.
To make matters worse, my brother wants to go back to Texas so he can spend time with his son, which is not a good idea with his condition, but that is another story. He may only be with us for a few more months, and wonder if I should give another "Snap shot" of my situation.
Because I am in some invisible queue to go in from the ALJ which could take over a year, I would like to get a reconsideration of my updated situation. Or am I stuck to simply wait for the judge, and not have my brother in our home (assuming we cannot talk him out of going to Texas).
