Medical Malpractice: Doctor Not Prescribing Medication on Time

My question involves malpractice in the state of: Alabama

I have epilepsy and am prescribed 3 different medications for it. Recently, my physician has started only calling refills in on the same day of the month they were previously filled, regardless of how many days were in the month. Therefore, on the months with 31 days, I am forced to go to the ER for the additional day(s) of medication.

I have spoken to both the office manager and the doctor himself but no one seems to understand or care of the predicament this puts me in. His response was, "if you don't like it, go somewhere else."

I have tried to find another physician but, being as I have Medicaid, every other doctor in my area either does not accept my insurance or is not accepting new patients. I'm at my wit's end. Is there any way to compel him to refill my prescriptions on time?
