My question involves a child custody case from the State of: New York
My ex and I have an order for child support. He is required to pay me for child support in addition to child care expenses as I have primary physical custody.
He is now arguing that every other weekend when he sees his child for visitation, he has to pay for child care (due to work) and now he is expecting me to pay for half. Note that he is only scheduled to work 1 day during the weekend, anything is excess of that is voluntary overtime. I asked him if he would like to change his visitation days to his days off so that he would not incur any child care expenses and he refused.
Is this legal?
