My question involves labor and employment law for the state of: Louisiana
I believe I was discriminated against because I had a disability in May of 2016. I have been a model employee for just short of 7 years. My doctor deemed me disabled due to severe carpal tunnel until I had surgery. During my leave I did not qualify for FMLA and went to my supervisor to ask for approved medical leave so that I could have surgery. I was out for 4 months having surgery on both wrists and returned to work at full duty. Upon my return I was put back into the same position as when I left and this was expected seeing as talked to my employer before I left, during my leave, and upon returning. On my second day back my supervisor pulled me and my coworker in his office. My supervisor (S) and coworker (C) laughed at me when my S told me that my C will be taking over my duties and I will be doing that C old duties. It took me four years to earn the duties and position I had. I was told I am a great employee and did nothing wrong and no complaints of my work. My employer explained to me that this change was made because they feared I would need additional time off work due to my hands. Despite the fact the employee taking over my duties was incapable of completing my surveying duties without my help. Before I left I was in charge of my office and of two employees. I never had any complaints of my work efficiency yet my duties where reassigned solely because I had a history of a disability.
Long story short June 2016 I filed grievance with my company claiming discrimination based on a disability. It was brushed under the table and I was told to be careful using that word. I became so depressed that I started having uncontrollable panic attacks and anxiety attacks. I was approved for FMLA in Sept 2016 and also filed workers comp. In Oct 2016 I was terminated for job abandonment, no call no show for 3 consecutive days, Oct 10 11 12 13. Even though I notified my employer 2 weeks before that I was unable to return to work as expected on Oct 10. I have emails with my S showing I was in touch with him on the 10th 11th and 12th.
Fast forward to the now. I filed a charge with the EEOC. I just received my employers statement for me to review. There is exhibits attached totaling 30 pages. I have noticed that the vac sic and fmla sheets they have dating back three years is incorrect when compared to my pay stubs. Also some of the evidence with my signature looks photo shopped. My question is, when I respond to the position statement how do I address the falsified exhibits provided by my employer?
