This happened in California if that makes a difference.
So I was driving down the street an my neighbor pulled right into the street (more halfway into a narrow street). I did not have time to swerve or stop completely. Luckily I was only going about 15MPH. My front end clipped her bumper.
There was a car parked at the edge of her driveway making a blind spot for her and for me to see her coming.
Her insurance just sent me a letter stating they are making me 80% at fault and her 20%. I think this is a total joke.
Basically the girl that pulled out is trying to say I was not looking. There were no witnesses so it is basically her word against mine. I thought it would be a no brainer so I did not contact my insurance right away because it was clearly her fault. Now I am waiting for what my insurance says.
I am totally confused. I know for sure that is is her fault. I had both hands on the wheel and facing forward - at most I checked my rear view mirror.
Any thoughts?
