My question involves a consumer law issue in the State of: Utah, southern Utah.
New construction next door on a higher lot. Property line is on top of a slope towards our property. They have built a wall on top of the slope, yet our intention was to excavate our land to gain more flat area for a future pool. They came while we were at work & built up the slope on our side in order to support their wall according to the building inspector & did so without our knowledge.
Do we have to keep the slope which is our land because it holds up their fence? Or are they (the higher lot) required to hold back their land from eroding onto ours?
