I am in NY state.
I live in a landowners association.
Before I bought my property, the association granted 'right of way' to an adjacent property owner which boarders my property.
He has employed a local logger to clear his property which occasionally logger will move heavy equipment in a 4-5am during the summer hours when windows are open and sound carriers well.
He also allows the logger to hunt on his property,with occasional gunfire early in the morning.I have seen the hunters and they say they have permission to hunt by the owner,and have hunting the land for years and have a 'right' to it.
My question is, does having right of way ,entitle him to allow anyone he invites on and through the association's property?
I have no problem having maintenance workers,contractors,utilities,deliveries ,friends and families using access as long as they are respectful,but do they all have a right on to our property?
