My question involves estate proceedings in the state of: Texas
My mother was meticulous in keeping records and making sure that all her CD's and IRA's were payable to me on death. I am the only child, the only heir, as my father passed before my mother.
After her death I have been able to close out her CD's and IRA's without difficulty except for an IRA at Bank of America. They claim that they don't have her beneficiary form, which in talking to other people seems to be a common occurrence for BofA to "lose" beneficiary forms.
No problem as I have her will naming me as the only heir. But Bank of America won't accept a will.....won't even look at it.
Now they are telling me that I have to submit a "Small Estate Affidavit" which I and two disinterested parties have to sign in the presence of a notary stating that my parents had no other children and that there is no will.
I don't like the idea of saying there is no will when there is. As far as I know the will isn't on file with county records, but this still leaves a bad taste in my mouth to have to basically lie.
