My question involves a child custody case from the State of: California
My ex and I agreed to a 730 evaluation since she is trying to move away with the kids (ages 10 & 15) and I would like to modify custody so that I will have physical custody. Our divorce agreement (five years old now) states that she has physical custody and I have visitation every other weekend. But for the last two years, the kids have had two overnights with me per week, plus every other weekend (about 39% of the time). The evaluator was supposed to determine 1) if there truly is joint physical custody in our case and 2) whether the move away should be granted based on the best interest of the kids. As for the evaluation, I had one meeting with the doctor, and each of my kids had one session, and my ex-wife had one session - all of us alone. I know that my 15 year old made it clear to the doctor that she wants to live with me. Expecting more sessions, home visits, etc., I followed up and the doctor's office says the report has already been sent to the court. What am I to make of this? Is that too quick? Should we demand a more thorough evaluation?
