My question involves a child custody case from the State of: Montana maybe CO or WA
I was with the mother of my child for five years. A year and a half of which was with our daughter. During the year and a half she illegally applied for tanf behind my back in Washington even though we lived in Montana (we did jointing apply for public assistance in Mt too) by claiming she was homeless and single even though I had a house for us and paid %100 of my child's and our financial needs (excluding gifts from our family). I did not sign birth certificate because I did an online conception calculator that but her out of town the two weeks during conception and there had been numerous infidelities. So I wanted genetic testing done before signing an 18 year connect with this woman. However immediately, I fell in love with my daughter and the paternity issues faded. But a year and half after my daughters birth her mother moved to North Dakota to be with another man leaving our child in my care back in MT. I soon moved to North Dakota so our child could be around both parents (one of the hardest things I ever did) We eventually came to a mutual agreement of monthly time for each of us. 30days on 30 off. (Which quickly turned into 60-70 percent of the time our child was in my care because her new boyfriend had a lot of money and they travel a lot) However she soon lost her job for embezzling and relocated to Wyoming for another job. I told her after six months I would consider moving there for our daughter but two months later she lost her job for theft (same as in ND) and moved to Colorado to live in her boyfriends house he owned but did not reside in (basically to keep her out of trouble). After three different states in less than a year, I was fed up uprooting my life and sick of ND because it was not suitable for our child so I moved back to where we had live previously Butte, MT. That was May,2015! Now our child is 9 months from school and obviously in need of a primary household and a custodial parent. I was employed most of my daughters life and her mom has less then six months work. I literally paid for everything (to be fair her father and new boyfriend have been very generous). Besides ND, Mt is the last place my child lived six consecutive months and following the subsections of the uniform parentage act; Jurisdiction. My daughter has way more ties to the community of Butte than any other. She has a regular day care here, her primary physician is here., her dentist is here, her paternal grandmother is here and we are ten hours closer to all of her relatives. Only five hours from most of them and I have gone out of my way to be sure my child has spent time with all her family even in her maternal side. He in Butte, Mt I rent a house here and my child has her own room (very well decorated I had to say so :) and many friends her age that she regularly visits. Not to mention she was conceived here (however she was born in Spokane because my father is an administrator off the hospital she was born at). I have began the process to enroll her in early head start Also like I said I have always been involved in her life. I have been emotionally and financially supportive from day one. I have filed head of house hold on my taxes every year since my child has been alive. I am the only one that has provided health insurance for her since she was born and since she was six months old, the only one who had brought her to dr and dentist appointments. In ND she was a part of my blue shield blue cross insurance through work and before had we all applied for public assistance and received insurance and now in MT since I have her over half time and her and I applied for public assistance. Food assistance and medical insurance. Not tanif! So my questions/worries are do I have a chance for establishing jurisdiction here in Montana? Because she has no ties to Co. No relatives, no day care. No friends nothing. And ND is not an option for either of us but Wa may have a case. Most of her relatives live in Spokane both paternal and maternal. And as I am establishing paternity and amending her birth certificate. Am I still going to be held finically responsible for and obligated to pay "back child support"" from before I established paternity. I have limited paper (receipts, mail, taxes) proof but a lot of personal testimony from employers, landlords, family and friends plus service providers dr. Dentist day care attendant etc. please help me clear up some of my concerns and prepare the necessary proof that will help me. (I did send a lot of money through MonheyGram I'm sure they would allow me to have a copy of our transactions! Sorry for the novel. Thank you
