My question involves labor and employment law for the state of: California
Hello! I was recently offered a job for a senior living facility in Southern California. I accepted this offer and was told I had to get a livescan fingerprint report done to complete a department of justice and FBI background check which would then bfe sent to the department of social services to clear me for work. I had the fingerprints done on 12/10/2015 and as of today my background check is listed as "delayed". The only thing on my record is a "traffic: failure to appear" misdemeanor from 2010, which the department of social services says can be waived as it is over 5 years old and nonviolent, but they can't do anything until the DOJ sends their final check to them. Could this be what is causing a status of "delay" on my background check? I also had a fake ID ticket which was completely expunged and does not show up on any criminal background check including government ones. My to-be employer is now saying that they cannot wait any longer to fill the position and are going to pull their offer. Is there anything I can do about this situation? I've tried talking to anyone I can get in contact with at the DOJ but I cannot get through to anyone and get an answer on what exactly is causing this delay. I can't believe I might have a job offer pulled from me due to the DOJ failing to process this report in a timely manner, but it looks like that may be what's happening here...
