My question involves an injury that occurred in the state of: Connecticut
Hi all,
I have a quick question about the statute of limitations in Connecticut regarding damage to vehicles from roadwork. I am planning on filing suit against the construction company who was performing the roadwork for the town, but am not sure if I am still able to based on the statute of limitations.
To sum up the incident, the construction company was contracted by AT&T to perform maintenance on underground lines. The company left a small strip of road unfinished across both lanes of traffic. After driving through said strip of unfinished road, the wheels on my car were bent past the point of repair. Thankfully, I was still able to drive on them safely, but they sustained irreparable damage and have be replaced. This incident occurred about 2 years and 4 months ago. Between college and other family "events", I have not believed I have had the time necessary to go through with every step a claim. I am claiming that the construction company was negligent because they did not put up proper signage warning of the road work and left the road in unsafe condition. I am 100% positive that the roadwork was what damaged my wheels. I believe I have a very strong case for this, so that is not my question.
Here's my question: Does my claim still fall within the statute of limitations? I am not sure whether this claim would fall under section 52-584 or 52-584a...if it even falls under either of those. For the sake of making everyone's life easier, below are the links to each statute. 52-584a says 7 years while 52-584 says 2 years, but then also mentions 3 years....If my claim falls under 52-584, I am not sure whether the limit would 2 or 3 years.
52-584: http://ift.tt/1WChToc
52-584a: http://ift.tt/1Sw1Brt
Any insight on whether I am still able file this claim would be greatly appreciated.
Thank you!
