Non-Performance and Breach: Suing Contractor for Poor Workmanship

My question involves a consumer law issue in the State of: Texas

I hired a contractor to tear down and rebuild about 1/3 of a house I purchased because of structural issues of an add-on. The house is built on a hill, so the back end of the house is two stories. The back end of the house was tore down and rebuilt by the contractor.

The floor and ceiling of the reconstructed area, on the upper level, are non level with the rest of the house (about a 3" slope over 15' feet). I did not notice this until I put in new flooring.

The construction occurred about 10 years ago. Do I have any recourse due to the length of time since the construction occurred?
