My question involves a traffic ticket from the state of: Michigan
I pulled into a clear driveway to turn around on a road, came to a complete stop and checked both directions multiple times to ensure both ways were clear before beginning to back out. Halfway onto the road I checked both directions again, both clear, then began to turn to line up on the proper side of the road and as I was about halfway straight I heard a honk and something hit my bumper simultaneously. I was 100% sure there was NO traffic when I was halfway onto the road, BUT I was backing at a slow speed so there was plenty of time for the other driver to turn onto the road I was on or approach from a block away. It was getting dark out, but I drive a large white truck and had my lights on, the other driver even admitted to seeing me backing, but chose to go onto the curb in an attempt to get around me instead of slowing and waiting a moment. With the speed limit, me being halfway into the lane, and being nearly impossible to not see he should have had plenty of time and the ability to slow down or stop. Due to blind spots with my truck I was still crawling backwards when he hit my bumper with his car, he was not at any point visible to me and I was not aware of his car until he honked and hit me at the same time.
My main question is, am I actually at fault since I am completely sure both directions were clear before I began backing and halfway onto the road?
In what manner should I present my argument when I fight the citation?
