Title Insurance: Minnesota Property Partially Owned by Ward of South Dakota Guardianship Program

I'm going to apologize in advance as I'm on the outside looking in on this issue and I don't have all the details.

My parents own a home in Minnesota. They are divorced and my father is currently living in Rapid City, South Dakota. As mentioned in the title he is in the South Dakota Guardianship program. After years of having their house on the marked they got an offer on the house with a scheduled close date of 6/6/2018. We've run into a legal headache though due to him being in the guardianship program. Both the buying and selling title companies have determined that the sale should be approved by the Minnesota courts because that is required for wards of the Minnesota guardianship program and they want to be cautious. The SD guardianship program hired a lawyer who doesn't believe this is necessary but the title companies are insisting.

Initially this was going to push the sale back 'a couple months' but the latest news is that the state of SD is planning to take legal action to get around this as there would be a cost of roughly $5k to get the paperwork through the MN courts.

I reached out to the attorney that the SD guardianship program hired today as he happens to be the father of one of my high school friends but he is out of office until next week.



Any input would be greatly appreciated. This feels like a case where we just need to figure out the right person to talk to and it could be resolved.
