My question involves a traffic ticket from the state of: Utah
Two days ago i was pulled over for speeding. The officer stated he clocked me on his radar going 74mph in a 55mph zone. I know this is a false reading as I had previously adjusted my cruise control to about 57mph in going with the flow of the traffic when I exited the freeway onto this four lane highway. In fact, I knew I had never been doing 74mph even earlier when I was on the freeway posted 70mph. One thing I can think of is his radar received a bounced signal when I changed lanes from behind the car in front of me as the driver of that car started to slow down when he saw the patrol car parked at the side of the road (he was doing about 57mph as well). I chose not to slow down, instead signaled and made a lane change, although it was a somewhat abrupt lane change as the car in front of me slowed down a lot more than I anticipated (well below 55mph). Needless to say, I was completely surprised when the patrol car came after me.
I told the officer his radar was in error. I drive this highway several times a week and I always reduced my cruise control to 60mph when I take the offramp from the freeway. Taking the offramp any faster than about 60 will put you into the guard rail. This is not an admission of guilt, as the first 55mph posted sign is about 3/4 of mile past the offramp. I explained this to the officer and asked him if he had observed me. He said yes, so I asked if he observed me going 74mph. His reply was he observed that I was going "fast". When he came back from his vehicle, he handed me my license and citation. He had officially charged me with doing 60mph in a 55mph zone, but commented on the citation that the radar speed was 74mph.
One other fact relative to this is that there was another patrol car from the same police department that passed me in the opposite direction several miles prior. He must have changed directions not too far behind me as shortly after I was stopped, this officer pulled up behind us. This leads me to question if this other patrol car's radar may also have created an error reading.
Any thoughts on how to best defend this will be greatly appreciated. I am 100% sure I was not going 74mph, or even 60mph.
