My question involves collection proceedings in the State of: South Carolina
My parents died 2 days apart, I inherited an acre of land they owned free and clear and it contained an old house used as storage, and a mobile home. The house had been paid for as well. My father was 100% disabled through the VA, so no taxes had to be paid on the property as long as he was alive. When he and mom died, the property taxes were outrageous, not only did the county tax for the acre, but split it into a lot as well, one containing the "house" listed at an $80,000.00 taxable property value, which was basically falling in and the other "lot" containing the mobile home, which is still in their names due to it not being paid off. So, in this state, mobile homes are taxed separately from "real" property. I gave that backstory to where I am now....the loan is w/US Bank, my husband had lost his job and had been jobless for over a year. I had a car payment to make, food to put on the table, help my brother, who was applying for disability due to a brain injury, and could not afford the payments on the mobile home. I had made contact several times. Sometimes I would get the reply that my emails had not been received to we will call you back on the matter, to which weeks would go by and they would not call back. They are now asking for the entire payoff for the mobile home or the mobile home itself. It's around $30,000.00 they are asking...I tried to get a bank loan, but due to my husbands lack of job history for a year, they said no. We went to a loan company, they said no. We have the collateral to get a loan, but no one will help. They are now turning it over to their "Legal Dept" for review and they will be in touch w/options. Since this mobile home was in my parents names and probate is closed on both estates, and home has been 'charged off' do we have a legal leg to stand on? Do they have the right to go after a debt that is really my parents? That they should have filed a claim against their estates in probate? Thanks for any help or suggestions. I work 3 jobs to attempt to make ends meet. My husband recently gained employment of a minimum of 40 hours per week and possibility of overtime, so making loan pmts at this time would not be an issue. I am not a deadbeat person, nor is he and this is really stressing me out.
