Custody and Visitation Issues: I Am Told I Lost My Parental Rights Because I Was in Prison

My question involves a child custody case from the State of Washington: (Although the 2010 custody order was issued in Virginia)

I was released from prison earlier this year after six years for the heat of passion crime of manslaughter. (I am not a sex offender, abuser, or a danger to my son.)

During the time I was incarcerated the Juvenile & Domestic Relations Court of Fairfax County in Virginia gave my mother custody of my son [Its his Grandmother]. I am not mentioned at all in this order and was told at the time that I did not need to be because he was my son and I would automatically get my son back when I was released.

During the time I was locked my sons grandmother took a power of attorney I had given her and changed the name of my son on his birth certificate to her maiden name.

Now she tells me that because I am not listed in the Virginia "Custody & Visitation Order" from 2010 that I lost my rights to my son.

I stayed in contact with my son the entire time I was incarcerated and was released to my moms address in Washington State from prison so I could spend time re-bonding with my 8 year old son. I need to move to find work and want to have my son live with me after I get a place. The grandmother told me she will not allow my son to leave and that because of the old order from Virginia that granted her custody it was not legal for him to not be with her.

Is this the truth? Does the order stay in effect even after I am no longer incarcerated? Do I have to change the order in Virginia or can I try to change the order out west here in Washington State?
