My question involves court procedures for the state of: California
Summary of Issue:
My car broke down due to a transmission issue, in which I had to have it fully rebuilt. 5 months after the shop I brought it to did the rebuild it broke down on the freeway, because of an improper transmission 4th gear ratio. I brought it back to the same shop, which they chose to "fix" it again for "free", in which case, it ended up breaking down a second time, due to improper repair and because of the wrong 4th gear ratio, again. I had to take more time off of work due to the improper repair, I was endangered on the road as were other drivers, I had to pay additional rental costs, twice, due to no car and being an hour away from my work, and I had it checked out twice by my main mechanic after the issues came up both times, which is how I found out about the 4th gear ratio being off. Added to that I had to take a lot of personal time to setup the small claim against this repair shop because they refused to pay the additional costs I had incurred and did not fix the car correctly the first time or second time.
Question(s):
My question is; what do you think is reasonable and protected under the law, as far as costs being refunded? The initial repair cost? Work-time lost? Rental fees? 2nd opinions for safety? Personal-time lost? Fees incurred for court procedures? Etc?
Is there any laws that protect me under these conditions? What are they? What costs do they cover?
