My question involves criminal law for the state of: South Carolina
Hello! Back in 2009 I got a ticket for possession of a fake ID (misdemeanor). I went to court and signed up for the pre-trial intervention. The court never mailed me anything and me, being a naive 19 year old college student, assumed maybe this meant I had somehow gotten looked over in the system. In spring of 2010 I was arrested and brought to jail, sentenced to 15 days for a failure to appear/bench warrant. Turns out the county had sent information and court date notices to me but had used an incorrect address and therefore I never received the notices. I was able to get a lawyer to have the warrant rescinded by the judge, and I was released from jail after 28 hours. I then went back to court with the lawyer and the judge ordered me to complete the pre-trial intervention (which I did and the original fake ID ticket is now expunged off my record). Fast forward to 2015 and I am looking for a job and a background check comes up with "failure to appear - misdemeanor" still on my record from this charge. It also says it is a "traffic misdemeanor" for some reason. Shouldn't the failure to appear have been dropped once the warrant was rescinded? How can I go about getting this off my record? Thank you!
