My question involves medical malpractice in the state of: Washington state
Can an ER refuse to treat a person in pain?
I have had a few horrible trips to my local ER. Due to guidelines on treating patients with pain- it seems like they have branded anybody who is in pain as an addict or a "drug seeker."
I have had Chronic Daily Migraines for the past 6 years. Every few months I will get a really horrific migraine with severe nausea & cannot keep any oral medication down long enough to work. I get dehydrated since I will throw up for days.
I see my doctor every month to go over pain management, dosing, & because I do need to take pain medications I submit UAs regularly that not only check what meds I have taken & what levels of meds are present (I have never had a UA that came back with a drug I wasn't prescribed or meds in higher doses than prescribed).
My local ER has labeled me as a "drug seeker" even when I bring my medicine with me (to show I'm not out of my meds), a doctor's note with his recommendation for treatment, submit a UA, & they still will not treat me.
Even after I was assaulted & had my head smashed against my car door frame & was transported to the ER in an ambulance, the ER refused to treat pain.
Can an ER refuse to treat a person in pain & dehydrated?
Thanks
