My question involves estate planning in the state of: Texas
My mother gave a life estate to her husband. She passed a few years ago and afterwards the deed was recorded with him having the life estate and my brother and I as the heirs to the property and the final 50/50 owners of the property. My question is 2 part..
First, he has since started dating someone and she has moved into the home. My understanding is this woman is not trustworthy and is a paralegal thereby having a better understanding of the ins and outs of the legalities than I do. The question here is, when he dies does she have any rights to stay in the home? In the state of Texas can I require her to leave or will I be required to employ the law to enforce this removal?
Second, What rights do my brother and I have regarding the home? Can we inspect the home at any given time (scheduled of course) to ensure that my asset/investment is being maintained properly and that all debts are being paid such as taxes, HOI, and HOA dues.
Actually, I just thought of a third question: Should I find out the home is not being maintained or that the taxes, HOI, or HOA dues are not being paid, is there anything that I can do to either force him to make the payments or somehow revoke the life estate and have them all removed?
