My spouse and I are partners in a business. We file a 1065 and receive K1s. We currently have a 50/50 split of the tax basis. We have no other income. I have child support arrears and I know this year they will take my part of our refund on our personal return to pay them. With filing the injured spouse form, I assume they would currently take half. So, if my spouse contributes additional money to the partnership, raising her tax basis and reducing mine, say to 70/30, would this then reduce the amount of our refund they would take since less is mine?
