My question involves a traffic citation from the state of: California.
I live in San Diego. After visiting the library for about an hour, I was surprised to discover my car had been towed away from the "2 Hour Parking" zone I had parked in. It had been parked on the street, directly next to a green "2 Hour Parking" sign. Confused, I approached a nearby Officer and asked him to point out why my car had been towed. He walked me to a sign that was posted in the red zone behind my car that explained the street was designated as a Tow Away zone during Petco Stadium events on a few specified dates and times (which happened to be within the time frame I had parked there).
The citation I received was under Section 22651n in the California Vehicle Code, which states a car can be towed:
(n) Whenever a vehicle is parked or left standing where local authorities, by resolution or ordinance, have prohibited parking and have authorized the removal of vehicles. Except as provided in subdivisions (v) and (w), a vehicle shall not be removed unless signs are posted giving notice of the removal.
My complaint is that the "2 Hour Parking" sign is extremely misleading if there's another "Tow Away" sign that can sometimes override it. Is this a valid complaint? The fact that the "Tow Away" sign is for a pretty irregular and temporary reason seems like the city should have taken extra care to make the rules explicit.
I found a recommendation in the MUTCD that, had it been followed in this circumstance, would have prevented the violation:
Section 2B.47
11 Where parking is prohibited during certain hours and time-limited parking or parking in a particular manner is permitted during certain other time periods, the red Parking Prohibition and green Permissive Parking signs may be designed as follows:
Two 12 x 18-inch parking signs may be used with the red Parking Prohibition sign installed above or to the left of the green Permissive Parking sign; or
The red Parking Prohibition sign and the green Permissive Parking sign may be combined (see Figure 2B-24) to form an R7-200 sign on a single 24 x 18-inch sign, or an R7-200a sign on a single 12 x 30-inch sign.
Is there any other information that would help me contest this citation? I have a court date in a couple weeks. At the very least, I'm hoping for leniency from the judge. Any advice would be greatly appreciated. Thanks in advance!
